Terms of Service
These Terms of Service ("Terms") are an agreement between you and Lurinth, Inc. ("LootPup", "we", "us"). They govern your use of the LootPup website, web app, Apple Wallet pass, and related services (together, the "Service"). By adding the LootPup card to your Wallet, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy and Rewards Terms, which are part of these Terms.
1. Who can use LootPup
- You must be at least 18 years old and a resident of the United States.
- You may hold only one account. Creating or controlling multiple accounts is a breach of these Terms.
- You must not be a person or in a location where use of the Service is prohibited by law.
2. Your account
An account is created when you add the LootPup card to Apple Wallet or sign in with Apple or Google. The link and QR code on your Wallet card provide access to your account, so treat your card like a key: anyone with your unlocked phone or a copy of the link can open your account. You are responsible for activity that occurs under your account. To protect a balance we ask you to link an Apple or Google sign-in, which is required before any cash out.
You must provide accurate information (including a valid payout destination) and keep it current. We may suspend or close accounts that provide false information.
3. Earning rewards
LootPup displays offers from third-party advertising networks and advertisers ("Partners"). Completing an offer according to its stated requirements, as verified by the Partner, credits your LootPup balance in accordance with the Rewards Terms. LootPup does not control whether a Partner verifies a completion. Balances are promotional credits with no cash value until a cash out is approved and paid; they are not a deposit, bank account, or currency, and they do not earn interest.
4. Cash outs
You may request a cash out of your available balance subject to the minimum and maximum amounts shown in the app. Requests are reviewed manually. We may delay, reduce, or decline a cash out where we reasonably believe activity on the account breaches these Terms, is fraudulent, or is subject to reversal by a Partner. Approved cash outs are delivered to the destination you provide; we are not responsible for payments sent to an incorrect destination you supplied.
5. Prohibited conduct
You agree not to:
- Use VPNs, proxies, emulators, virtual machines, device-ID spoofing, or automated tools to complete offers or create accounts;
- Complete an offer on a device or app account that is not new to that app when the offer requires a new user;
- Create multiple accounts, share accounts, or complete offers on behalf of another person;
- Provide false information, including a payout destination you do not control;
- Interfere with, reverse engineer, scrape, or overload the Service;
- Use the Service for any unlawful purpose.
Violations may result in forfeiture of your balance, reversal of paid rewards to the extent permitted by law, and permanent closure of your account.
6. Third-party services
Offers are provided by Partners under their own terms and privacy policies. When you start an offer you may be directed to a Partner's or advertiser's app or site, and information about your completion is shared with that Partner (see the Privacy Policy). LootPup is not responsible for Partner or advertiser content, apps, or conduct.
7. Taxes
You are responsible for any taxes on rewards you receive. Where required by law we may request taxpayer information and issue tax forms, and we may withhold cash outs until requested information is provided.
8. Changes and termination
We may change the Service, offers, payout methods, limits, or these Terms at any time. Material changes to these Terms will be posted here with an updated date, and continued use after that date is acceptance. You may close your account at any time by contacting support@lootpup.com; any balance below the cash out minimum, or subject to an unresolved investigation, is forfeited on closure. We may suspend or terminate accounts for breach of these Terms or if we discontinue the Service.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that offers will be available, that completions will be verified by Partners, or that the Service will be uninterrupted or error-free. Earnings are not guaranteed.
10. Limitation of liability
To the fullest extent permitted by law, Lurinth, Inc. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount of your approved but unpaid cash outs or (b) US $50.
11. Indemnity
You agree to indemnify and hold harmless Lurinth, Inc. from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.
12. Disputes, governing law, arbitration
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and LootPup each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration clause by emailing support@lootpup.com within 30 days of first accepting these Terms.
13. General
These Terms are the entire agreement between you and LootPup about the Service. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.
